The rules for using EasySpeed. Your rights, our protections, fair for everyone.

1.Agreement to These Terms

By using EasySpeed, you agree to these rules. If you don't agree, don't use the platform.

These Terms form a legally binding agreement between you and EasySpeed ("EasySpeed," "we," "us," "our"). By accessing or using easyspeed.cl or any related apps, services, features, content, or tools (the "Service"), you agree to these Terms and confirm you have read and understood them. If you do not agree, do not use the Service.

If you use the Service on behalf of a team, club, school, or organization, you represent you have authority to bind that organization, and "you" includes that organization.

2.Who We Are

EasySpeed is based in Chile and serves swimmers and coaches worldwide.

EasySpeed is a swimming performance analytics platform headquartered in Chile and offered globally. The Service supports English, Spanish, Portuguese, and French. The Service includes race-video analysis tools, a multi-objective scoring system, practice tools, team features, community features, and related analytics.

3.Eligibility (Age & Authority)

You must be old enough to use the platform. Under certain ages, a parent/guardian must consent.

  • Minimum age: You must be at least 13 years old to use the Service.
  • Users 13–15: You may use the Service only with verifiable consent of a parent/guardian, and the parent/guardian is responsible for your use.
  • Users 16+: You may use the Service independently (subject to local law).

Coaches, teams, and organizations are responsible for ensuring they obtain any required parental permissions when inviting minors, uploading minor videos, or processing minor data. We may request proof of age/authority and may suspend accounts if we suspect ineligible use.

4.Your Account & Security

Keep your login safe. Don't share accounts. You're responsible for what happens under your account.

  • You must provide accurate account information and keep it updated.
  • You are responsible for all activity on your account, including content uploaded and actions taken.
  • No credential sharing: You may not share accounts or login credentials.
  • You must promptly notify us at hello@easyspeed.cl of any unauthorized access or suspected breach.
  • We may require security steps (e.g., email verification, device checks) to protect the Service.

5.Subscriptions, Trials, Billing & Refunds

Paid plans renew unless you cancel. Coaches get a 14-day free trial (no card). Paid plans have a 7-day money-back guarantee.

5.1 Plans & Features

EasySpeed offers athlete plans (Free, Solo at $15/mo, Team+ at $20/mo) and coach plans (Starter through Enterprise, $25–$199/mo) with varying athlete slot limits and features. Add-ons include +Swimmer ($5/mo), Assistant Read Only ($10/mo), and Assistant Full Access ($25/mo). Plan details are displayed in-product and may differ by currency, region, and payment provider.

5.2 Trials

Coach accounts may receive a 14-day free trial. No credit card is required to start a trial. Trial eligibility is determined by EasySpeed. We may limit trials to prevent abuse (e.g., repeated trials, multiple accounts).

5.3 Auto-Renewal & Cancellation

Paid subscriptions auto-renew unless you cancel before the renewal date. You can cancel via your account settings or by contacting support. Cancellation stops future billing; you retain access until the end of the current billing period unless otherwise required by law.

5.4 Payments & Providers

Payments may be processed through Stripe (global) and/or Mercado Pago (Latin America), with provider selection based on region detection. We do not store full card numbers; we may store customer/payment identifiers.

5.5 Taxes

Prices may be exclusive of taxes unless stated otherwise. You are responsible for applicable taxes, duties, or bank fees.

5.6 7-Day Money-Back Guarantee

If you are on a paid plan, you may request a refund within 7 days of the start of a new paid period, unless prohibited or modified by local consumer law. We may deny refunds where there is evidence of misuse (e.g., chargeback fraud, automated scraping, prohibited competitive use, or repeated refund requests across multiple accounts).

5.7 Promo Codes

Promo codes: (i) have no cash value, (ii) may expire, (iii) may be limited to one per user, (iv) may be revoked if obtained or used improperly.

6.Acceptable Use Rules

Use EasySpeed for swimming performance analysis and coaching. Don't break laws, abuse people, or attack the platform.

You agree not to (and not to help others to):

  • Violate any law, regulation, or third-party rights.
  • Upload content you don't have rights to use (including videos of others without permission).
  • Harass, bully, threaten, dox, or exploit others—especially minors.
  • Post hateful, discriminatory, or sexually explicit content; or content that encourages self-harm.
  • Attempt to bypass paywalls, subscription gating, role permissions, or security features.
  • Interfere with the Service (e.g., DDoS, load testing without permission, malware).
  • Use bots, scrapers, crawlers, or automated extraction tools without our written approval.
  • Use the Service for non-swimming purposes that materially conflict with intended use (including using the Service primarily to copy, benchmark, or replicate our systems).

We may remove content or restrict accounts to enforce these rules.

7.Your Content (Videos, Data, Posts) & Our License

You own your videos and posts. You give us permission to process them to run EasySpeed. We can use anonymized aggregates to improve the platform.

7.1 Your Ownership

You retain ownership of content you upload or submit, including videos, timestamps/markers you create, notes, comments, and posts ("User Content").

7.2 License You Grant to EasySpeed

You grant EasySpeed a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, cache, reproduce, process, analyze, adapt (for technical formatting), display, and transmit your User Content solely to:

  • Provide and operate the Service (e.g., video playback, frame-by-frame marking, split calculation, analytics, coach review, sharing settings).
  • Improve and secure the Service (e.g., debugging, performance optimization, fraud prevention).
  • Create aggregated and anonymized datasets and insights that do not identify you.

7.3 Privacy Controls

Some features are social/community-driven. Visibility options (public/private/team/followers) are set within the Service. You are responsible for choosing appropriate visibility settings.

7.4 Deleting Your Content / Account

You may request deletion of your account and associated personal data as described in our Privacy practices (see Section 13). Some limited data may be retained where required by law or for legitimate purposes (e.g., billing records, security logs).

7.5 Your Responsibilities

You represent that you have all rights and permissions needed to upload User Content, including permissions from athletes appearing in videos (and parents/guardians for minors), and that your User Content does not infringe third-party rights or violate laws.

8.Proprietary Technology, Trade Secrets & IP Protection

EasySpeed is built on original systems and proprietary engineering. You can use it — but you can't copy it, extract it, or rebuild it.

8.1 Our IP

The Service and all underlying technology are owned by EasySpeed or its licensors and are protected by copyright, trademark, trade secret, and other laws. This includes, without limitation:

  • The "5 Key Objectives" framework and its components (including the specific names Dive, Top Speed, Turn, Pace, and Finish; their definitions, scoring methodology, metrics, structure, color coding, and presentation as trade dress).
  • The stroke count algorithm, including its logic, confidence scoring, interpolation methods, gap estimation, and data structures.
  • The race entry, marker, and analysis data model (schemas, object models, workflows, segment analysis types).
  • The race wizard flow and UX sequence for frame-by-frame marking and automated calculation.
  • The AI voice-to-practice and practice assistant prompt engineering and practice schema encoding.
  • The entitlements/subscription architecture, feature gating system, and plan structures.
  • All source code, APIs, database schemas/migrations, UI/UX layouts, copy, brand assets, logos, and design system.

You receive only a limited right to use the Service as intended under these Terms. No rights are granted by implication.

8.2 Trademarks

"EasySpeed," "Stop guessing. Start dropping time," the "5 Key Objectives," and related marks, logos, and branding elements are owned by EasySpeed. You may not use them without written permission except to truthfully refer to the Service (e.g., "I use EasySpeed").

8.3 Trade Secrets

Certain aspects of the Service (including algorithms, prompts, scoring rules, and internal workflows) are confidential trade secrets. You agree not to misappropriate, disclose, or use them except as allowed by these Terms.

9.Anti-Copying, Anti-Reverse Engineering & Competitive-Use Restrictions

Don't reverse engineer. Don't create a clone. Don't use EasySpeed to train competing AI or extract our systems. These are core protections.

9.1 No Reverse Engineering

You may not (and may not allow others to):

  • Reverse engineer, decompile, disassemble, decrypt, or attempt to derive source code, algorithms, prompts, data models, or underlying ideas from the Service or any part of it.
  • Circumvent security, access controls, or feature gating.
  • Probe, scan, or test vulnerabilities without written permission.

9.2 No Clones, Derivatives, or Competitive Replication

You may not use the Service to create, improve, or support a competing product or service that replicates or is substantially similar to EasySpeed, including any system that:

  • Scores swimming performance using substantially similar multi-objective categories, structure, metric mapping, or visual trade dress;
  • Replicates the race-wizard sequence, marker workflow, or analysis flow;
  • Replicates the stroke counting approach, interpolation logic, or confidence outputs;
  • Replicates the practice schema/prompt-based voice-to-practice conversion or prompt structure.

This restriction applies whether you build the competitor for yourself, an employer, a client, or any third party.

9.3 No Automated Extraction / Scraping

You may not scrape, crawl, harvest, or use automated means to access or extract any part of the Service UI/UX, analytics outputs at scale, data related to scoring, rules, prompts, or system behavior, or any user content you are not authorized to access.

9.4 No Training Competing Models

You may not use any outputs of the Service (including scores, split analytics, exported datasets, or structured practice JSON) to train, fine-tune, evaluate, or improve competing algorithms or AI models that are intended to replicate or substitute for EasySpeed—unless you have written permission from EasySpeed.

9.5 Confidentiality of Non-Public Information

If you access non-public or premium/coach features, you agree to keep non-public product details confidential, including any non-public beta features, internal scoring explanations beyond what is shown to typical users, and any non-public documentation or admin tools.

9.6 Acknowledgment of Irreparable Harm

You agree that any breach of Sections 8–9 would cause irreparable harm to EasySpeed for which monetary damages are inadequate, and that EasySpeed is entitled to immediate injunctive relief without the requirement to post bond where permitted by law, in addition to any other remedies.

9.7 Reasonable Scope

We intend these restrictions to be enforceable to the maximum extent permitted by law. If a court finds a portion overbroad, it will be reformed to the minimum extent necessary to be enforceable.

10.Output, Analytics, Scores & No Performance Guarantee

We show analytics to help you improve, but we can't guarantee PBs. It's not medical advice.

The Service provides informational analytics and tools based on user inputs (including frame-by-frame markers). Results can be affected by video quality, human marking accuracy, pool conditions, and other variables.

  • No guarantee: We do not guarantee performance improvement, personal bests, selection to teams, scholarships, or any outcome.
  • Not medical advice: The Service is not medical, injury prevention, or rehabilitation advice. Consult qualified professionals for health concerns.
  • Athlete safety: You are responsible for training decisions and safety.

11.Coaching, Teams & Role-Based Access

Coaches and assistants only get the access you grant them. Teams must respect athlete privacy and permissions.

11.1 Roles

Roles may include Athlete (Swimmer), Coach, Assistant Coach, and Admin, with varying permissions.

11.2 Coach/Athlete Relationships

Coaches may access athlete data only as permitted by team relationships and athlete privacy controls. Coaches are responsible for obtaining any required consents for minors.

11.3 Assistants

Assistant access may be read-only or full-access as an add-on. Coaches are responsible for managing assistant permissions and removing access when necessary.

12.Feedback, Suggestions & Beta Features

If you send ideas, we can use them. Beta features may change or break.

12.1 Feedback

If you provide suggestions, ideas, or feedback ("Feedback"), you grant EasySpeed a perpetual, worldwide, royalty-free right to use, modify, and incorporate that Feedback without compensation or obligation.

12.2 Beta Features

Some features may be labeled beta/preview. Beta features are provided "as is," may change, may be discontinued, and may have higher risk of errors.

13.Privacy, Data Protection & International Transfers

We don't sell your personal data. We process data to run the platform and comply with laws like GDPR/LGPD/CCPA where applicable.

We handle personal data as described in our Privacy Policy (incorporated by reference). Key points:

  • We process personal data to provide the Service, prevent fraud, provide support, and improve the platform.
  • We may use aggregated, anonymized data to improve the Service.
  • We do not sell personal data.
  • Data may be processed internationally (e.g., where our infrastructure/providers operate).
  • Users may have rights to access, delete, correct, or export their data depending on jurisdiction.

If you are in the EU/UK, Brazil, or other regions with data protection laws, additional terms may apply (see Section 22).

14.Third-Party Services & Integrations

We rely on providers like Stripe, Mercado Pago, Supabase, Vercel, and AI providers. If they have outages, we're not responsible for their failures.

The Service may integrate or rely on third-party services, including payments (Stripe, Mercado Pago), hosting/deployment (Vercel), database/auth/storage (Supabase), AI APIs (Anthropic/Claude), and video processing/transcoding tools. Third-party services are subject to their own terms and policies. EasySpeed is not responsible for third-party failures outside our reasonable control.

16.Suspension, Termination & Data Retention

If you violate the rules, we can suspend or terminate your account. You can also delete your account.

We may suspend, restrict, or terminate access immediately if:

  • You violate these Terms,
  • We suspect fraud, scraping, reverse engineering, or competitive misuse,
  • We must do so to comply with law or protect others.

Upon termination: your license to use the Service ends; we may retain limited data as required by law (billing/tax), for security, or dispute resolution. Refunds (if any) follow Section 5 and applicable local law.

17.Disclaimers

The service is provided "as is." We don't promise it will always be available or error-free.

To the maximum extent permitted by law, the Service is provided "as is" and "as available." We disclaim all warranties, express or implied, including fitness for a particular purpose, merchantability, and non-infringement. We do not warrant uninterrupted operation, error-free outputs, or that results will meet your expectations.

18.Limitation of Liability

If something goes wrong, our liability is limited as much as the law allows.

To the maximum extent permitted by law:

  • EasySpeed will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenue, data, goodwill, or business opportunities.
  • EasySpeed's total liability for any claim relating to the Service will not exceed the greater of: (a) the amounts you paid to EasySpeed in the 12 months before the event giving rise to the claim, or (b) USD $100.

Some jurisdictions do not allow certain limitations, so these limits apply to the extent permitted.

19.Indemnification

If your content or misuse causes legal trouble, you cover us.

You agree to defend, indemnify, and hold harmless EasySpeed and its officers, directors, employees, contractors, and agents from claims arising out of:

  • Your User Content,
  • Your violation of these Terms,
  • Your infringement of third-party rights,
  • Your unlawful use of the Service.

20.Changes to the Service or Terms

We may update features and terms. If changes are big, we'll give notice. Continuing to use the platform means you accept.

We may modify the Service or these Terms. If changes are material, we will provide reasonable notice (e.g., email, in-app notice). Continued use after the effective date of updated Terms constitutes acceptance.

21.Governing Law, Arbitration & Dispute Resolution

Chile law governs. Disputes go to arbitration in Santiago (with some exceptions), which helps international enforceability.

21.1 Governing Law

These Terms are governed by the laws of Chile, excluding conflict-of-law rules.

21.2 Informal Resolution First

Before filing a claim, you agree to contact us at hello@easyspeed.cl and attempt to resolve the dispute informally within 30 days.

21.3 Arbitration (International)

Except where prohibited by law, disputes arising out of or relating to these Terms or the Service will be resolved by binding arbitration seated in Santiago, Chile, administered under internationally recognized arbitration rules (e.g., UNCITRAL Arbitration Rules or an established arbitration institution selected by EasySpeed), conducted in English (or Spanish if both parties agree). The arbitrator may award injunctive relief and enforce IP protections.

21.4 Court for Injunctive Relief (IP/Security)

Notwithstanding arbitration, EasySpeed may seek injunctive or equitable relief in any competent court to protect its IP, trade secrets, confidentiality, or security (including anti-scraping, anti-reverse engineering, and anti-clone enforcement).

21.5 Consumer Rights

If you are a consumer in a jurisdiction that mandates local courts or non-waivable rights, those rights remain unaffected.

22.Country/Region Addenda

Some places require extra rights (EU/UK GDPR, California CCPA/CPRA, Brazil LGPD). This section aligns the Terms with those rules.

22.1 EU/UK (GDPR/UK GDPR)

If you are located in the EU/EEA or UK: you may have rights to access, rectify, erase, restrict processing, object, and data portability. International transfers may rely on recognized safeguards (e.g., SCCs) as described in the Privacy Policy. Where EasySpeed acts as a processor for coach/team accounts, additional data processing terms may apply.

22.2 United States (CCPA/CPRA for California)

If you are a California resident: you may have rights to know, delete, correct, and opt out of certain data sharing as defined by law. We do not sell personal data as described in Section 13 (subject to legal definitions).

22.3 Brazil (LGPD)

If you are located in Brazil: you may have rights under LGPD, including confirmation of processing, access, correction, anonymization, deletion (where applicable), and information about sharing.

22.4 Other Jurisdictions

Where local mandatory laws apply, they override conflicting Terms only to the minimum extent required.

  • "Service" means easyspeed.cl and all related features, tools, and content.
  • "User Content" means content you upload or submit (videos, posts, comments, markers, notes, etc.).
  • "EasySpeed IP" means all proprietary technology, systems, algorithms, prompts, designs, schemas, trade dress, and brand assets.
  • "Trade dress" includes the overall look-and-feel, presentation, colors, and distinctive UI identity that indicate source.
  • "Coach Account" means an account with team/athlete management access.
  • "Outputs" means analytics results, scores, splits, trends, structured practice JSON, and reports generated by the Service.
